2. PRODUCTS
All the products we distributes come from Tuscan companies and represent typical specialties of Tuscany. All the photos in the website www.tuscansweets.com reflect the key characteristics of the products even if may differ in terms of color and other particulars. To make an order you have to sign up by clicking on “login” (If you do not have an account yet, you can create your account here). Use the form provided and enter your data such as Username (email) and Password, which will be used for future access and purchases. Later you just have to enter your email and password to see your data and modify them. The email and password management depends only on the customer, who undertakes to promptly inform us about any unauthorized email address or any violation of safety rules. ??? The user undertakes to sign out by clicking on “sign out” after every session. Our website undergoes a detailed access control and through the login we are able to prove any customer's behavioral discrepancies and to contest them.
To confirm the reception and the acceptance of the purchase order, the customer will receive an email containing the order summary.
3. PRICES
Sale prices are showed on our website, applicable fees such us VAT should be added when invoicing. The payment can be made by bank transfer (the purpose must contain: the order number, the name and the surname of the customer or the name of the company that placed the order) , credit card or PayPal. The prices on our website www.tuscansweets.com could be updated or modified at any time, they will be valid since their publication on our website, except the previously submitted orders.
4. AVAILABILITY
In case a product is not available, TuscanSweets srls will first send the available products in the order and successively the others, the transport costs will be borne by Tuscan Sweets srls. If out of production, insofar as seasonal products, we will reimburse you through bank transfer. The partial delivery does not give the customer the right to refusal of delivery, reimbursement or compensation.
5. SHIPMENT
The shipment of the products by courier takes place in 7-10 working days from the reception of the order and the payment. The customer is required to verify the conformity of the goods being delivered, the correspondence quantitative and qualitative of the ordered products and their integrity. Being artisanal and, where possible, preservative-free products, will be our care to deliver them as soon as possible.
6. TRANSPORT COSTS
The prices do not include transport costs, they vary depending on the weight and the volume of the shipped products. They will be automatically calculated by filling out the form for the order on the website www.tuscansweets.com. To speed up the delivery, a telephone number must be provided, in order to directly contact the customer and avoid stocks and re-deliveries. For what it concerns shipping outside the European Union, customs duty and other taxes are extra to pay. They will be calculated and invoiced with a different document which has to be paid before the shipment.
7. RIGHT OF WITHDRAWAL / COMPLAINTS
The customer has the right to return the product within 14 days of receipt. This right applies to individuals acting for purposes not related to their professional activity. Therefore, purchases made by retailers and companies are excluded from the right to return. The right to return has to be stated by sending a written communication through A.R. registered letter to "Tuscan Sweets srls - Via delle Arti 2/b 53100 Siena" within 14 days of receipt. The statement must include the products codes you intend to return, indications on the modality of refund of the expenses and eventual bank account details.
In the event of a complaint and acceptance of return and replacement of the products, they have to be returned undamaged by the customer. Once we have received the product and we have verified its integrity, we will replace it as soon as possible. The customer must bear the cost of returning.
These conditions of sale are regulated by articles 50 to 68 of the Decree-Law n° 206/05. According to article 55, second subparagraph, of the Consumer Code, the customer has no right of withdrawal in the following cases: supply of audiovisual products or sealed software once opened by the customer; supply of tailored products or products that by their nature cannot be returned without risk of rapid deterioration or alteration ( such as food, cosmetics, flowers…)
Why is it not possible to return food products? To protect our customers and for hygienic reasons the right of withdrawal is available only for products that can be resold without giving rise to potential consumer health risks. This is why it is not possible to return food products whose correct conservation cannot be guaranteed.
8. PRICES AND CONDITIONS UPDATE
Conditions contained in this document may be updated or modified at any time and will be valid from the date of publication in our website, expect already accepted orders.
9. FORUM
For any dispute, shall have jurisdiction the forum of Siena.
These conditions of sale are regulated by Articles 50 to 68 of the Decree-Law No 206/05. According to Article 55, second subparagraph, of the Consumer Code, the customer has no right of withdrawal in the following cases: supply of audiovisual products or sealed software once opened by the customer; supply of tailored products or products that by their nature cannot be returned without risk of rapid deterioration or alteration (such as food, cosmetics, flowers etc.)

The right of withdrawal shall not apply to the supply of foodstuffs that by their nature cannot be returned without risk of rapid deterioration or alteration.
